Can we sell Dummy 13 and remixes?

The original Dummy 13 model has an attribute license that allows commercial selling. I thought remixes had to use the same license but the ones that I’ve looked at all have a non-commercial license. Can those be sold or not?

No you can’t sell dummy 13 remixes with non commercial terms in their licence.

The rules with Cc licenses is that you can’t remove terms to a licence. In this case you can’t remove the attribution terms and published a remix under CC0 public domain license.
But nothing prevent you to add your own terms to your remixed model license, like : NC - non-commercial, ND - no-derivative, SA - share-alike.

Thank you very much for the explanation!

Did the original have a “CC BY 4.0” license? Derivatives made from something with that license can’t be more restrictive than the original, so no, they can’t add “no commercial” to it.

[ NOTE: SEE POSTS BELOW, IT’S MORE COMPLICATED THAN THIS. ]

But I caution you that just because you know what the license is now for a model, they didn’t necessarily use that version when they copied it. A change of the upstream license doesn’t magically invalidate the license on those derivatives made with the old license.

So the answer to your question is really follow the license on what you are printing.

That’s not correct.

If you want the derivatives of your work to be published under the same license as yours, you should add SA (share alike) in your license terms.

Thanks for looking it up!

No problem, I’m myself scratch my head during a longtime before understanding how those CC licences really works in regards to remixes.

And since this info is kinda hidden inside a kilometre long FAQ page, I’m glad to help

Let’s imagine there was a Dummy 13 who’s head was too small. So you remix it and make one with a bigger head by scaling it. Can you change the license now to include NC? This would suggest not:

If I derive or adapt material offered under a Creative Commons license, which CC license(s) can I use?

If you make adaptations (Frequently Asked Questions - Creative Commons) of material under a CC license (i.e. “remix”), the original CC license always applies to the material you are adapting even once adapted. The license you may choose for your own contribution (called your “adapter’s license”) depends on which license applies to the original material. Recipients of the adaptation must comply with both the CC license on the original and your adapter’s license.

I’ll try to explain my interpretation of this legal content the best I can in English (not my first language)

In clearer terms, your remix need to comply with the terms of the original license. You need to give proper attribution to the original content creator and the license allows derivative works. So everything is compliant here.

This is referring to the table I have shared previously.
And it clearly states you can apply some other licenses to your remix.
In short, you need to respect the “duties/must” of the license but you can remove the permissions/can. (You must attribute, you can remix).

And your example is an interesting study case, because your only have modified the head.
And let assume, you have published the remixed model with all the other original parts under CC BY NC.
Only your remixed head will not be allowed to be used for commercial use since your are in fact just sharing all the other parts. So the original license will still apply to them.

At least, it’s the way I understand it
