Car logos - Intelectual Property Violation

I had the same happen to me. My Harley bar and shield logo lightbox was removed last night for the same reason…

In the mean time, loads and loads of Harley stuff is still out there…

I consulted my favorite AI for some legal loopholes but it basically said it is not possible to appeal this… Too bad. I guess the rest will disappear shortly as well..

It’s on brand to see that Harley is doing these notifications 1) themselves and 2) 1-by-1 manually it seems lol

I wish them good luck and to hire a developer.

Re: the “David-Harlyson” → if that was actually the text on the 3d model itself, this is probably fair use. If that was just the text used in the listing page advertisement meant to avoid bot scraping, and the model itself was just their trademark, you should let this one go

The crest might also be protected no matter what name you end up using. :person_shrugging:

Not shocked though and kinda surprised it took this long. HD really likes to keep a tight leash on their name. I think they transitioned into a t-shirt company that sells an occasional motorcycle.

Agree. I do not have faith that the AI algorithm would understand the basis of “parody” anyway. And then there is the shape of the logo itself - bar & shield. I looked back on this particular model and have decided that it had a good run as it was posted some 2.5 years ago. Guess I should feel honored it was possibly #1 to be chosen first out of 800 plus models.

The dream is over before it even began :frowning:

Harley might hate that but I love it! Guessing that’s purely AI rendered though?

Yeah, 100% generated for the purpose of making the joke.

Ahhh yes. The rare special order 3 muffler model. Don’t post the STL.

I just had my two Harley clocks taken down. It’s would appear that someone decided to click on the IP button and report them. I asked Maker World is this was just a pick and choose as to what Harley items are removed seeing that there are over several hundred HD items still listed. I don’t think Maker World is going out of their way to remove them, more like someone reported them because their item wasn’t getting the same attention and points,

It happens automatically, but with a delay. Just because you can still see some of them doesn’t mean those models aren’t affected. MakerWorld probably just doesn’t want to overload its own system and does it in waves, but never all at once.

That’s how it was with the last few wipes, too.

Also, it’s not really MakerWorld that decides that - it’s simply the search engine and its database. There’s no human involved anymore; it happens automatically. There’s no selection process - it’s just a false impression you have because there’s a delay.

This will go on for the next few weeks, until every one has been caught.

I dunno, I think the ones that come from purpose-built companies (that only do trademark infringement) are the ones who bot it out and actually get the sweeps done. I’d like to thank tundra for sharing the content of the message, which shows that at least the person filling out the form claimed they were from Harley itself. “Claimant : Harley-Davidson Motor Company, Inc” Your message will read “Claimant : Infringement Reports Inc” or whatever if its just a legal mill with bots, acting under the behalf of the owner.

Small scale operations like the legal dept of a real company that makes real products are gonna just shotgun the top 100 and call it a billable-month. The bot companies build automation to filter and send reports on every single one, and keep records that ensure every notice is followed thru or else makerworld themselves gets the next legal notice.

I don’t believe IP infringement reports can be made by anyone other than the IP owner or a designated representative.

There was a time in America when companies were expected to be good neighbors. That is they tended to contribute heavily to the community they were part of. When a business did well, the entire community did well. Then something changed. When it was decided that companies’ only real purpose was to make money for the shareholders. Many who had no connection to the communities that the businesses operated in. Then the great consolidation occurred when most small companies disappeared, having been taken over by mega corporations. As such, there are a far fewer local businessmen with a concern for the community. Instead we have giga millionaires who could care less about everyone else. Here they are, coming after their biggest fans. They do not care and never will.

If you design and print logos of corporate trademarked products you are giving them free advertising. That is until one of their agents comes along to screw you over. Corporations are not your friend and never will be.

One should strive to create original products that don’t depend on other people’s logos. Unless of course, the trademark holder is paying you big bucks to do so.

Legally, correct

In practice?
Its a web form with 0 authentication, doing the legal version of “trust me bro”, that automatically pulls down a listing. You can upload a picture of your butt as proof. lol. Sure, you risk maybe a countersuit, but that portion requires a hired lawyer $$,$$$.
