This all assumes this company hasn’t obtained commercial licences, but, I know one designer who had many of his models stolen, no commercial agreement in place, he has managed to have them removed.
Sorry to hijack this thread, but I too have my model stolen from MW and is currently being sold on Amazon for $60ea !!! I had a Creative Commons licence forbidding commercial use etc etc. I’ve spoken to this guy online but he thinks it’s ok cos he made a couple of ‘minor’ changes (so he could print it correctly). I’ve also made my model ‘personal’ so it can’t be downloaded - very disappointed. My model was ONLY available on MW for personal use only. How do I contact MW about this? I’m going in circles to find a link or email to their legal team, support or office. TIA - Shawsie.
MakerWorld will not do anything as they only get involved for Exclusive program models and your license choice means it could not be part of that program,
Your license clearly states it can’t be used commercially, the fact he made changes doesn’t change that, it just means he guilty of two things.
You will need to show the licence to Amazon (documented claim) and the correspondence where he admits it is your work. Given he said he changed it, he has stated it is yours.
Instead of etc etc etc, exactly which license did you select? Don’t type the answer, copy the picture from your model and paste it into the message so I can see it.
And I’d like to thank you for using a CC license, please don’t let your single bad experience scare you away from them. He probably would have done the same thing with the standard license.
This is not a makerworld problem nor do they profess to offer support in this area, so you shouldn’t expect (or even request) any help from them. That being said, they actually have in the past flexed a little muscle against another Chinese firm, but you should not expect any help. Again, you should not expect help.
My general advise would be to tread carefully, IP law, especially in other countries, is complex. I know your case seems straightforward to you but there are a lot of factors at play. People think “oh, the worst that can happen if I file a complaint with Etsy/Amazon/Ebay is that they ignore it”. That by far is not the worst thing that can happen.
