Ebay user selling designs without permission

Hi,
someone on ebay.it is selling lots of designs from mw.

any suggestions what to do?

You can probably report them to Ebay, unless they have commercial licenses.

i didnā€˜t give him a commercial license, he is even using the mw pictures

This is all I get

you guys need to STOP believeing everything you read here. The guy might post this link above on purpose to get traffic to the page or any other malware ā– ā– ā– ā– ! just DONT click any random links users post here. simple right?

What model of yours is he using? Any makerworld link?

are you serious? Iā€˜m not looking for traffic, i post this to inform users that their models might get sold without permission.

Huh? Sorry, but it goes to a page on Ebay.it. The italian version of ebay.

Pretty sure itā€™s not malware.
As for driving traffic, it has no affiliate code in the URL, and I never plan to buy something from italian ebay? So what does it matter how many times I click it.

Chill out bro

itā€˜s the brick logo clock i designed.

This one right? I asked because i couldnā€™t find any reference to your makerworld profile.
In ebay you have to file a report but i wouldnā€™t hope much since they take long to answer and i donā€™t know if being ā€œlegoā€ it wonā€™t bring any questions to the table in terms of licensing. Try it

Also important. What was the license before going Exclusive? You can also use the Exclusivity program and report a ticket to Makerworld so they can take matters, as they say in the terms. itā€™s a good time to make use of that exclusive program

yes, i canā€˜t give anyone permission to sell stuff like that because iā€˜m not the owner of the logo.

The exclusivity program is for models, not prints.

And if they are more lightboxes like this, David80ā€™s models would be ineligible for inclusion in the exclusive program anyway:

3.2 Intellectual Property Requirements

The Exclusive Program Models must be the Creatorā€™s original work, or the Creator must have obtained all rights, licenses (including exclusivity rights), permissions, consents, and releases from the lawful rights holder that are necessary to participate in the Exclusive Model Program or 14-Day Exclusive Launch Program.

8.2 The Creator further promises and guarantees the following

8.2.1 Exclusivel Program Models are the original design and creation of the Creator and will be exclusively displayed on the MakerWorld platform. A Model will be considered ā€œnon-originalā€ if it meets any of the following criteria, as determined by MakerWorld in its reasonable discretion:

ļ¼ˆaļ¼‰Coies, plagiarizes, or is a re-upload of another Creatorā€™s Model or otherwise infringes or misappropriates any intellectual property, privacy, or other rights of any third party throughout the world;
ā€¦
ļ¼ˆdļ¼‰Model violates applicable laws and regulations such as copyright law, trademark law, design law, patent law, or other third party rights and /or Community Guidelines, relevant policies, public order and good morals, or societal ethics; or

As per the digital license it says otherwise and so it should applicable here. But i am no attorney

You shall not share, sub-license, sell, rent, host, transfer, or distribute in any way the digital or 3D printed versions of this object, nor any other derivative work of this object in its digital or physical format (including - but not limited to - remixes of this object, and hosting on other digital platforms). The objects may not be used without permission in any way whatsoever in which you charge money, or collect fees.

oh well, i guess i have to get an ebay.it account

You donā€™t need to be an attorney. The exclusivity program isnā€™t the ā€œdigital licenseā€, itā€™s a way to get special points. Anyone can use the ā€œdigital licenseā€, they donā€™t need to be in the program. They are unrelated.

The rules are here.
